111310 - and losing the data on the hard disk, when we tried to restore the

112908 - an upgrade program.  He said that Andrea is not authorized to offer
112909 - replacements outside Exabyte's corporate policies. Luther advised that
112910 - Exabyte continues to sell, service and support the 4200c drives.  He
112911 - said the Exabyte 4200c record of performance is within spec.  I did
112912 - not mention not having seen in the product spec continued failure.

112923 - that any disparity between my understandings and Exabyte's policies is

112934 - failure on the restore suggests that any or all of the backups we have
112935 - made over the past 1.5 years may be defective.  The record of
112936 - continued failure on interim backups supports the latter conclusion.
112937 - Moreover, we recently incurred expense of buying new 4 MM Dat tapes
112938 - out of concern that the tapes we were using may have been defective.

112945 -     1.  Exabyte will replace our 4200c drives with refurbished model
112946 -         8505 8 MM drives.  They will have a 1 year warranty.

112948 -         Luther said Andrea confirmed that Gazele supports the 8505.

112950 -     2.  The customer can purchase in the market place new Exabyte 8 MM
112951 -         Dat drives of any model and submit the invoice to Exabyte
112952 -         along with the defective 4200c drives and a history of the
112953 -         problems experienced by the drive.  Exabyte then determines,
112954 -         based on years of use, how much of a rebate to award and
112955 -         writes a check to the customer for that amount.

112957 - I explained my reluctance to spend time shopping for a drive and that
112958 - depending on Exabyte to make an accurate estimate of an equitable
112959 - rebate amount seems risky.  Therefore, I am drawn to option 1.  So far
112960 - Exabyte's drives have not survived a one year warranty, so the one
112961 - year seems long enough to make sure it is going to be reliable.

112963 - I asked why Luther cites the model 8505 and explained my concern about
112964 - getting another model that is either no longer supported or soon to be
112965 - discontinued, as seems to be occurring with the 4200c.  Luther said
112966 - the 8505 is the Exabyte flagship tape backup drive and so will be
112967 - supported by Exabyte for many years.  He advised that Exabyte has a
112968 - large installed base of these drives in the field and it has proven to
112969 - be very reliable.

112971 - As a result of Luther's explanation, I agreed to option 1, replacing
112972 - the current 4 MM Dat drives with 8 MM Dat drives, model 8505,
112973 - including the two tapes for each drive offed by Andrea.

112976 - then forward the matter to their Customer Service department.  They
112977 - will contact us with an RMA number.  I explained we would like Exabyte
