1008 - Summary
1009 -
100901 - I explained SDS corrections on outlining Jeff asked about the other
100902 - day. Reviewed Subject Index procedures and using the Reports feature.
100903 - Jeff has printed the Help system, as a manual.

1013 -
101301 - Advised I fixed the outline function so it will not set a margin on a
101302 - sentence that begins with something like "Mr. Jeff Ghilardi," or "Dr.
101303 - Smith," etc, per our discussion at ref SDS 10 line 0813.
101304 -
101305 - Jeff tried this on the laptop and feels it solves his concern.

1016 - Subject Index & Reports with F1 F9
1017 -
101701 - Jeff said he has started to build a formal subject index. Up to now
101702 - he has been mainly using the Diary Summary to retrieve SDS informa-
101703 - tion.
101704 -
101705 - Comment
101706 - Learning Period Difficulty
101707 -
101708 - This suggests how difficult it is for people to realize the value
101709 - of the Subject Index. Morris and others seek some form of magical
101710 - transcendence (also called "artificial intelligence") that will
101711 - eliminate the need to think through the structure of one's work,
101712 - life and activities. I seek rather to provide SDS as a simple
101713 - tool to apply native intelligence through language on the things
101714 - it does best: thinking, analysis, pattern recognition. SDS
101715 - captures in real time, or nearly real time the results of human
101716 - intelligence so it can be re-used as a resource to build new
101717 - understandings as a result of the context that evolves based on
101718 - the correlation of events, people, time, documents, cost and
101719 - schedule. The SI is a primary element of this objective. Jeff
101720 - has been using SDS for several years without using the SI to
101721 - organize his thinking and work product.
101722 -
101723 - This suggests that while it is easy to use the SDS tools, it is
101724 - quite difficult to understand why they are valuable, or worth the
101725 - time to think through the structure of one's work.
101726 -
101727 -
101728 - We went through the process of making a project SI, and I explained
101729 - how to transfer an index created for one project or account to another
101730 - account.
101731 -
101732 - He had a problem using F1 F9 of not placing it on the main organiza-
101733 - tion line. This was opening a Doc Log report screen, instead of the
101734 - Contact screen. I explained that F1 F9 opens the Doc Log report
101735 - screen, if the cursor is not on a data type for one of the other main
101736 - reports, Subject, Reference or Contact. We did this a few times and
101737 - he seems to have it in mind.
101738 -
101739 - Actually I can fix this so if the cursor is on any part of a
101740 - Contact line, it will do a Contact report, similar to being able to
101741 - open a Contact record with <Enter>.
101742 -
101743 -
101744 - Problem with F1 F9 on Doc Log Report
101745 -
101746 - There seems to be a problem with this function.
101747 -
101748 - Once we open a Doc Log report with this function, it wants to
101749 - continue to open the same report, even after moving the cursor to a
101750 - data type for another report. Evidently we are not resetting the
101751 - flag for this thing.

1020 - Help - Need Written Manual
1021 -
102101 - Jeff said he has printed the entire Help system, so he can read
102102 - through the whole thing. He prefers this so he has a complete
102103 - overview of the program rather than using the context sensitive Help
102104 - system. I explained the "Overview" help screens provide what he is
102105 - seeking, but he prefers to read the detailed text as well.

DTL Claim, Declarations, Jeff Ghilardi

1105 - Summary
1106 -
110601 - Jeff received DTL documents from Sarah and reported on a discussion
110602 - with her on this matter.
110603 -
110604 - Gave him the files on a disk, ref OF 1 and 2, so he can prepare his
110605 - own version of his declaraton.

1109 - Discussion
1110 -
111001 - Jeff said Sarah called him several days ago, and sent him some of the
111002 - claim materials prepared by Welch, including the orginal analysis
111003 - prepared in connection with Sletten's DTL claim.
111004 -
111005 - These include the documents Welch assisted DNRC in printing so they
111006 - could evaluate the DTL claim. The printing did not come out very well
111007 - so they are difficult to follow.
111008 -
111009 - I asked him to write out in this record his understandings from his
111010 - discussions with Sarah, which are as follows:
111011 -
111012 - Jeff's Comments
111013 -
111014 - 1. Sarah advised Jeff that she was concerned about a potential
111015 - conflict between the draft findings of fact with regard to the
111016 - Sletten draft tube issues and the Voith issues.
111017 -
111018 - 2. Sarah indicated that since she was not seeking to recover
111019 - punative damages from Voith, that she did not want to attempt to
111020 - prove that Voith deliberately provided unattainable tolerances.
111021 - She indicated that while it may be a true statement that she did
111022 - not consider it to be material to her case.
111023 -
111024 - 3. Jeff advised Sarah that he could not provide a declaration in
111025 - support of any claim against Tudor Engineering Co. However, he
111026 - will provide a declaration in support of DNRC's claim against
111027 - Voith. Jeff indicated to Sarah that he would prefer to write
111028 - the declaration in his own words and would provide a draft for
111029 - review based upon the form which Rod has developed.
111030 -
111031 - 4. LIST OF DOCUMENTS REQUESTED BY JEFF GHILARDI
111032 -
111033 - Jeff stated that he would like to have copies of the following
111034 - items in order that the statements made in the declaration can
111035 - be more fully supported.
111036 -
111037 - a. Copies of Jeffs diaries during the time period in
111038 - question.
111039 -
111040 - b. Copies of the various schedules. Sletten, Voith,
111041 - As-built.
111042 -
111043 - c. Copies of installation measurements by voith and sletten.
111044 - This should include measurements during the course of the
111045 - work. Sletten may have working notes, check Tudor field
111046 - notes on surveys, check Voith field notes.
111047 -
111048 - Copies of correspondence on the subject.
111049 -
111050 -
1111 -
1112 -
1113 - Jeff's Initial Approval
1114 -
111401 - Jeff said he had read through the initial draft of his declearation,
111402 - ref OF 2, and found it generally accurate. He needs the SDS records
111403 - and the items he has listed above to complete his review.
111404 -
111405 - He also submitted a copy of a declaration he offered on a Seawest
111406 - matter. He said the initial draft of his declaration by a lawyer was
111407 - not strong enough, and he re-wrote it. He also indicated that his
111408 - side was successful in that litigation and he feels his testimony in
111409 - the hearing that followed his declaration contributed to that success.
111410 -
111411 -
111412 - He said Sarah expressed concern about conflicts between ref OF 1 and
111413 - 3, but did not mention anything as being conflicting.
111414 -
111415 -
1115 -
1116 -
1117 - Additional Information
1118 -
111801 - I will arrange with DNRC to provide the records he requests and will
111802 - prepare an extract of SDS covering the Broadwater project for the
111803 - period of his declaration, which roughly 880801 to 881231. He can
111804 - install this on his computer to expedite his review of the record and
111805 - finalize his declaration.
