- Millie's letter to the medical team, was also sent to the children for
- information on progress recovering from 9th relapse of cancer, and to
- supplement the prior letter to Kim on 090630 commending family support
- and inspiration for Millie to continue treatment under difficult
- clinical, logistical, and financial challenges. ref SDS 26 IY5H

- [On 100121 1513 Millie attached this letter to a letter
- transmitting Christmas picture. ref SDS 66 BR8S
- ..
- [On 100123 1600 AT Millie's birthday party, the family
- encouraged Millie to plan a vacation cruise in the
- Meeteranian during May; hopefully, will relieve stress and
- worry handling difficult case manaqgement. ref SDS 67 XJ86
- ..
- Millie's letter today says...
-
- 1. Subject: Meeting at Kaiser Treatment Plan 10th Relapse, INR 3.7
- Date: Wed, 20 Jan 2010 13:24:00 -0800
- ..
- 2. First, I got a call from your assistant in Oncology at Kaiser
- that our meeting tomorrow is changed from 1200 to 1120, because
- you now have another commitment at 1200. She also indicated
- you have another patient ahead of me, so tomorrow will hurried
- and hectic. Therefore, I am taking time today for
- comprehensive review of issues, so the medical team can make
- progress, regardless of limited time in the meeting tomorrow.
- ..
- 3. Second, for Gloria, case manager in Kaiser's Coagulation
- Control Clinic, INR 3.7 was reported for the lab yesterday on
- 100119, implementing guidance from Kaiser adjusting Coumadin,
- reported in patient history on 100105. ref SDS 54 VH4M
- ..
- 4. On 100112 Doctor Johnson extended treatment for shingles
- another 2 weeks [actually 10 days, ref SDS 64 G65N]. Please
- advise of adjustments in warfarin to meet the target range 2.0
- - 3.0.
- ..
- 5. For the medical team, I had hoped to have full recovery from
- shingles by this time, [suggested by Doctor Zhan during
- examination at Kaiser on 100104 1115], more than 2 weeks after
- initial symptoms. ref SDS 52 QB59 As of yesterday, bleeding
- blisters still covered about 33% of my right forehead, which
- causes considerable pain. Thankfully, Oxychodone (Percocet)
- helps control pain.
- ..
- 6. Good news -- today suddenly shingles has significantly cleared
- on my forehead, so maybe this will be over soon.
- ..
- 7. On 100112 Doctor Johnson paused treatment for cancer 2 weeks
- due to diagnosis of shingles. ref SDS 64 G68H This 2-week
- "treatment holiday" was confirmed by a call yesterday afternoon
- from Anne in the Oncology Chemotherapy Infusion Clinic. I
- cannot find research that explains association between shingles
- and cancer/chemotherapy, other than concern about immune system
- [...cited by Doctor Zhang at Kaiser on 100104. 100104 1115,
- ref SDS 52 PS49; and, which aligned with guidance from Kaiser's
- pharmacy on 090601 0818. ref SDS 20 FR8L...].
- ..
- 8. Research shows several vaccines are available to reduce risks
- of shingles recurrence [reported on 100104 1115. ref SDS 52
- IS5I], and can be given to me after I recover from the first
- attack [see further research on 100112, ref SDS 64 0941],
- hopefully in a week or so. Since my age is a major risk factor
- for shingles recurrence [also shown on 100104. ref SDS 52
- N76I], tomorrow I would like to schedule getting the shingles
- vaccine. Several people have told me they got shingles
- multiple times, so I want to avoid this risk.
- ..
- 9. H1N1 flue vaccine can also be discussed tomorrow.
- ..
- 10. The MRI test was performed yesterday [reported on 100119 1130.
- ref SDS 65 MO5I], which you ordered during the meeting last
- week on 100112, to evaluate severe headaches. ref SDS 64 KC5J
- Lori, the MRI technician advised that the analyst's report
- takes 5 days. She further explained that you can get a "wet
- read" today to support the meeting tomorrow. If possible, I
- would like to get preliminary results to prepare for the
- meeting tomorrow.
- ..
- 11. During the meeting last week on 100112 there was discussion of
- getting a CT scan that includes vital organs in the neck,
- chest, abdomen and pelvis, as we have been doing the past 8
- years. You demurred seeming to indicate that nothing in a CT
- test would influence treatment, and so only the head was
- scanned yesterday to evaluate recent headaches [reported on
- 100112 0830. ref SDS 64 L54N].
- ..
- 12. Tomorrow, I want to consider getting a full CT scan for best
- evidence on cancer spreading to internal organs and bones. A
- big lump has developed the past few weeks at the left collar
- bone near my throat. Bones seem to ache in my chest where
- radiation was performed in February and March 2009. The past
- number of weeks I have felt bad inside my chest. I forgot to
- mention this during the meeting last week, because there are so
- many things to remember [see report on 100112 0830. ref SDS 64
- 448F]. Oxychodone has saved the day with welcome relief. Some
- days I feel like my whole body is failing. As noted, today I
- feel much better with shingles subsiding considerably, so my
- face does not look so bad.
- ..
- 13. Obviously, evidence of cancer spreading impacts Hospice
- considerations, listed in your medical chart. If a CT test
- shows I am a "lost cause," I would prefer to spend my remaining
- time without the constant burden of medical logistics. Can a
- CT scan provide a better picture on how much effort to invest
- on further treatment? [...requested during meeting at Kaiser on
- 100112, and not ordered by Doctor Johnson on the grounds that
- CT testing would not influence treatment planning. ref SDS 64
- L54N...].
- ..
- 14. During an earlier meeting at Kaiser last year, when I was
- hospitalized for painful breathing, you noted that even though
- the past 20 or so CT/PET/MRI tests over the past 8 years have
- never found evidence of cancer in my internal organs, there is
- likely cancer at very low levels, which is resisted by synergy
- between treatments and my immune system, strengthened with
- vigorous exercise. This combination was very effective until
- July, when UCSF changed the prescription from "targeted" to
- general chemotherapy, first with Gemzar and now Navelbnine.
- While I got through the 8th relapse of cancer under this
- regimen, former synergy between treatment and exercise was
- reduced to zero. Therefore, I am great risk until the team
- prescribes targeted treatment so that synergy is restored
- between treatment and exercise, as you explained during the
- meeting on 030606.
- ..
- 15. My last CT test on 090919 ordered in the ER to assess painful
- breathing found no evidence of cancer, not even in lymph nodes,
- including the neck, which have been early warnings in the past.
- Therefore, if a new CT test shows my cancer has not spread
- internally, e.g., to bones, lungs, liver, pancreas, etc., and
- if we can find a "targeted" treatment that does not have
- debilitating side effects, then I am prepared to continue work
- treating my "stage V" cancer as a "chronic disease," as you
- prescribed on 090213. ref SDS 16 GC6N
- ..
- 16. Good news -- the lab last week, and again yesterday the lab on
- 100119 show rising blood counts, signaling evident strength of
- my immune system, with ANC 5100 (NEUTS 5.1 at UCSF), just about
- the highest I have ever had 8 years. Elevated WBC 7.0 may
- reflect the immune system is reacting to shingles infection,
- but now my red blood cell counts have finally increased to
- within specified targets, after 4 - 5 months of low labs.
- ..
- 17. Better news -- CA 15-3 212 for the test last week on 100112,
- declined after rising 2 weeks earlier to 248. Improvement in
- the cancer marker aligns with your examination at Kaiser later
- that same day on 100112 finding significant response to
- Navelbine chemotherapy. ref SDS 64 3U7H IBC on my left arm and
- across my chest, as well as lymphedema, all improved, except
- for one lump on the upper left chest near shoulder joint.
- ..
- 18. Again, as noted, this morning I am feeling very energetic with
- the prospect of brighter days ahead, now that my breathing has
- improved, and shingles seems to be ending. No doubt the "chemo
- holiday" also helps a lot.
- ..
- 19. We can discuss in the meeting tomorrow at Kaiser resuming
- treatment for cancer starting the 3rd cycle of Navelbine next
- week on 100127, in order to give the medical [time] time to
- assess trade-offs of available "targeted" treatments [case
- study on 090725 shows requests for trade-offs on alternative
- treatments to optimize Millie's care. ref SDS 30 X66O].
- ..
- 20. During the meeting last week on 100112, you reviewed PARP
- treatments, ref SDS 64 N586, prescribed by Doctor Rugo at UCSF
- on 090616, and again in UCSF's recent letter to Kaiser on
- 100105 [received in the record on 100108 1618]. ref SDS 61 FM5I
-
- [On 100302 0830 Doctor Johnson advised that Doctor Rugo has
- still not had time to return Kaiser's calls on starting
- Millie on PARP at UCSF in order for Millie to recover from
- cancer spreading due to UCSF medical mistakes. ref SDS 69
- L86L
- ..
- 21. At that time while meeting in your office at Kaiser on 100112,
- you also reviewed an article in the Fall 2009 issue of "Cure,"
- which on page 52 explains PARP technology that is targeted to
- my triple negative patient profile, and so attacks my cancer
- without debilitating side effects. Recall this "targeted"
- feature of PARP was the basis for Kaiser prescribing cetuximab
- at UCSF on 070105. ref SDS 2 VQ5K
-
- [On 100218 1000 Millie discouraged by severe side effects
- from chemotherapy and difficulty getting timely care to
- recover from advancing cancer caused by medical mistakes at
- UCSF;, ref SDS 68 XE6I; Doctor Johnson reminds Millie she
- has a lot to live for, and that new treatments are becoming
- available everyday. ref SDS 68 XE6X
- ..
- 22. Since Kaiser's prior prescription of care "targeted" to my
- patient profile provided a high quality of life for nearly 2
- years, allowing me to work, exercise, and contribute to family
- and community, this presents an effective standard of care for
- treating my looming 10th relapse of cancer, which is likely to
- occur in the next few weeks, based on patient history with
- sunitinib and Gemzar, particularly since we were forced to
- pause treatment due to shingles. Investing time to be prepared
- for the 10th relapse of cancer, reflects your many warnings
- that because Kaiser and UCSF have been successful treating my
- stage IV cancer for 5 years, my cancer has moved to a much more
- aggressive "stage V" condition that requires starting the next
- treatment quickly following progression. Since this is a new
- condition, there are few treatments available, opening an
- opportunity to innovate both treatment and s
- ..
- 23. In your review of PARP treatments last week, there was
- discussion that Kaiser typically does not support phase 1
- clinical trials, because this conflicts with evidenced-based
- medicine practiced at Kaiser.
- ..
- 24. In this case, Kaiser should make a reasonable effort to recover
- from UCSF medical mistakes failing to treat cancer in my
- breastbone area, which caused cancer to spread, and severely
- impacted my breathing, both beginning on 090401. At that time,
- on 090401 I requested treatment. UCSF delayed treatment until
- the "wound" in my breastbone healed, mistakenly believing this
- was reaction to radiation. On 090609 Doctor Hsu in the UCSF
- Radiology Oncology Department discovered the "wound" is
- actually cancer that was untreated for nearly 6 months, causing
- cancer to spread. UCSF took immediate control of the case and
- within 7 days on 090616, started me on MPA prescribed by Doctor
- Hsu to recover from radiation mistakes.
- ..
- 25. Doctor Rugo advised on 090616 that "everybody at Kaiser and
- UCSF is on board" for treating my cancer as a chronic disease
- targeted to my patient profile. The doctor further indicated
- that after MPA, UCSF would treat me with PARP, as the newest
- line of targeted treatments for my cancer. ref SDS 24 D647
- ..
- 26. Since UCSF is responsible for the cost to recover from medical
- mistakes providing radiation medical services on referral from
- Kaiser during 090219 - 090317, Kaiser is responsible to fairly
- represent my interests. This requires making the best judgment
- of treatment for me based on the best evidence possible for my
- case. I have tried my best to be a team player and accept
- severely debilitating treatment the past 6 months with
- conventional chemotherapies using Gemzar and Navelbine that are
- not "targeted" to my patient profile. Since I spend most of my
- time in bed due to these treatments, and apart from the recent
- shingles affliction, I would like a written explanation
- comparing trade-offs for expected effectiveness and side
- effects of the many "targeted" treatments under consideration
- in my case, and cited in the letter submitted to the medical
- team at your request on 090326 0947, ref SDS 19 QM3V [and
- citing the letter earlier that day on 090326 0058. ref SDS 18
- DW5S - case study on 090725 shows requests for trade-offs
- comparing treatments based on best evidence. ref SDS 30 X66O].
- ..
- 27. Since my case is complicated, making a detailed review of
- available treatments takes a lot of time. Your assistant
- called today and said that you have to compress our meeting
- scheduled tomorrow at 1200, which typically takes an hour or
- so, because you have another commitment at 1200, and so want to
- meet me at 1120, and that you have another patient ahead of me.
- As you know, I have no problem accommodating your schedule.
- Indeed I greatly admire your work ethic taking on so many
- responsibilities. Limited time, however, does not relieve
- Kaiser and UCSF from responsibility to recover from medical
- mistakes in this case.
- ..
- 28. In the meeting on 090909, you expected to have time for this
- work, ref SDS 31 VF60; but, like today, your schedule later
- changed, since this has not been done. Similarly, Doctor Rugo
- has not had time to make this review. Kaiser should therefore
- hire someone to perform the work on identifying my next
- treatment based on the best evidence possible for my case.
- Costs to recover for UCSF medical mistakes are chargeable to
- UCSF.
- ..
- 29. Since I have received most treatments for breast cancer,
- protocols now have to be adjusted to treat my stage V condition
- in order to recover from medical mistakes that caused cancer to
- spread beginning on April 1, 2009. Doctor discretion has
- supported numerous waivers of protocols for my care the past 8
- years, and so can be applied now to provide essential care in
- time to be effective. This needs to be investigated to
- prescribe treatment, like PARP, targeted to my patient profile,
- so I do not suffer further debilitating side effects.
- ..
- 30. Kaiser and UCSF have a lot of talent and resources for
- innovation and medical care. Therefore, the fact that Doctor
- Johnson and Doctor Rugo are busy should not prevent recovery
- from medical mistakes reported on 090609, that occurred from
- UCSF providing care on referral from Kaiser during February and
- March 2009.
- ..
- 31. Since I am ECOG performance score 0, this is nominally a long
- way from Hospice. I would none-the-less like to get review of
- available treatments and testing to see if this might be an
- appropriate choice me at this time.
